When Judges Get It Wrong - the Case of John Fleming

It is not only juries that sometimes get things wrong, especially in cases of alleged historical sex abuse.  Judges get it wrong, too.  Just look at the South Australian case of Catholic priest Fr John Fleming.  This case amply demonstrates the need for judicial system reform.

A new book just out by David Pierre casts fresh light on one of the scourges of modern legal practice.  This is the new curse of guilt by accusation.  Nothing is less likely to eradicate the heinous crimes of child sex abuse that the attacks by the mob on the innocent.

The Crucifixion of John Fleming

The recent public and legal focus on the George Pell case obscures many other, less publicly known cases of innocent Catholic priests being falsely accused of sex crimes.  One relates to Fr John Fleming.  His awful story needs to be told and the lessons from it learned.

Face-Coverings and Testimony in Court

Should a Muslim woman who wears a face covering for religious reasons, be entitled to give evidence in court with her face covered? This important issue, which has been discussed in other common law jurisdictions, has now been considered in the NSW Court of Appeal, in Elzahed v State of New South Wales [2018] NSWCA 103 (18 May 2018). The Court concluded that no error had been shown in a ruling by a trial judge, that Ms Elzahad was not entitled to keep her face covered while testifying.
